Court says ‘no’ to interim relief for Tejpal

Goa Police opposes bail application, saying the matter was serious in nature

New Delhi: The Delhi High Court Tuesday declined to give interim relief to Tehelka news magazine editor-in-chief Tarun Tejpal after the Goa Police opposed his plea for anticipatory bail.

Justice Sunita Gupta declined to give any relief to Tejpal, who is facing charges of sexually assaulting a journalist colleague, and asked the police to file a reply by Wednesday.

Goa Police opposed the bail application, saying the matter was serious in nature. The police said they have not received a copy of the bail application.

Tejpal’s counsel K.T.S. Tulsi and Geeta Luthra asked the court to pass an order granting him protection from arrest till Goa Police filed its reply.

“I am asking for one day’s protection. I am not running away from country,” Tejpal’s counsel Luthra pleaded.

Tulsi added: “This has become a political battle. I am entitled to interim protection.”

Tulsi said that at best, the case related to outraging the modesty of a woman.

“It is a figment of imagination that it has become a case of (rape). Even the girl has not made any statement to police,” Tulsi said.

A Tehelka journalist has accused Tejpal of sexually assaulting her twice at a five star resort in Panaji this month.

Tejpal Friday asked investigators to “examine and release the CCTV footage so that the accurate version of events stands clearly revealed”.

Tejpal said that the registration of a first information report and the investigation by the Goa Police was a result of the BJP’s vendetta to satisfy a “long standing grudge” against him for the investigative journalism he did against the party when it ruled the country.

In 2001, Tejpal was behind a sting operation on leaders of the BJP-led National Democratic Alliance government that exposed corruption in defence deals.

It resulted in the resignations of then BJP president Bangaru Laxman and defence minister George Fernandes.

Tejpal claimed that the FIR in which he has been booked for rape was registered in “pursuance of a well-planned criminal conspiracy to falsely prosecute” him.

The investigation “is being used as an opportunity to satisfy the longstanding grudge of the political executive against the crusade, work and ideological stand of the present petitioner”, the petition said.

तरुण तेजपाल प्रकरण के विरुद्ध दुर्गा वाहिनी का प्रदर्शन

बलात्कारियों व दुराचारियों की गिरफ़्तारी हेतु राष्ट्रपति को सौंपा ज्ञापन

नई दिल्ली, 26 नवम्बर, 2013।  महिलाओं के विरुद्ध बढती उत्पीडन की घटनाओं से आहत दुर्गा वाहिनी व मातृ शक्ति ने आज दिल्ली के जंतर मंतर पर जम कर प्रदर्शन किया और राष्ट्रपति  से इस सम्बन्ध में शिकायत करते हुए एक ज्ञापन सौंपा। विहिप की महिला शाखा मातृ शक्ति की प्रान्त संयोजिका श्रीमती सिम्मी आहूजा व दुर्गा वाहिनी की प्रान्त संयोजिका श्रीमती संजना चौधरी ने प्रदर्शनकारियों को सम्बोधित करते हुए कहा कि आज हमारे साधु संतों को तो मात्र शक के आधार पर जेलों में डाल दिया जाता है जबकि हाई प्रोफ़ाइल अपराधियों को कानून का मजाक उडाने व न्याय व्यवस्था को प्रभावित करने के लिए खुल्ला छोड दिया जाता है। दिल्ली की बहिन के साथ गोवा में घटी बलात्कार व दुराचार की घटना को लगभग एक पखवाडा बीतने के बावजूद आरोपी तरुण तेजपाल व साथियों की गिरफ़्तारी तो दूर उनके द्वारा मामले को मनमाना रूप दिया जाना न्याय व्यवस्था का मखौल उडाया जाना नहीं तो और क्या है?  

हाथों में “नारी शक्ति का अपमान, नहीं सहेगा हिन्दुस्थान”, “नारी का सम्मान करो, तेजपाल गिरफ़्तार करो”, “शीला आन्टी की सरकार, नारी उत्पीडन की भरमार”, “नारी की अब यही पुकार, बहुत हो गया अत्याचार”, “तेजपाल से यारी क्यों, नारी पर वह भारी क्यों” इत्यादि नारे लिखे प्ले-कार्ड व भगवा झण्डे लिए महिलाएं बडी संख्या में प्रदर्शन में सामिल थीं।

प्रदर्शनकारियों को विहिप दिल्ली के उपाध्यक्ष श्री अशोक कुमार, संयुक्त महा-मंत्री श्री राम कृष्ण श्रीवास्तव, मातृ शक्ति की प्रान्त सह-संयोजिका श्रीमती संध्या शर्मा व श्रीमती  नूतन जैन, श्रीमती सीमा अरोड़ा व दुर्गा वाहिनी की प्रान्त सह संयोजिका कु0 कुसुम सहित अनेक वक्ताओं ने सम्बोधित किया तथा बाद में एक प्रतिनिधि मण्डल ने राष्ट्रपति भवन जा कर उन्हें ज्ञापन दिया।

ज्ञापन की प्रति मीडिया को जारी करते हुए विहिप दिल्ली के मीडिया प्रमुख श्री विनोद बंसल ने बताया कि अपने दो पृष्ठ के ज्ञापन में मातृ शक्ति व दुर्गा वाहिनी ने कहा है कि गत कुछ वर्षों में देश की आधी आबादी (महिलाओं) के विरुद्ध अपराधों की बाढ सी आ गई है। माताऐं व बहिनें बार-बार बलात्कार व यौन उत्पीडन का शिकार बन रही हैं। गोवा के तरुण तेजपाल प्रकरण ने तो पूरे देश को नई तरह से सोचने पर मजबूर कर दिया है। ज्ञापन में गुनहगारों को कड़ी से कडी सजा, फास्ट ट्रैक कोर्ट का गठन, पुलिस काउन्सलिंग की व्यवस्था, शिक्षा प्रणाली में नैतिक शिक्षा व आत्म सुरक्षा (जूडो कराटे इत्यादि) को अनिवार्य बनाकर शराब व अन्य सभी नशीले पदार्थों के सेवन पर पूर्ण प्रतिबन्ध की मांग की गई है। ज्ञापन की प्रति केन्द्रीय गृह मंत्री के साथ दिल्ली व गोवा के राज्यपाल व मुख्यमंत्रियों को भी भेजी गई है।

New Delhi. Nov 24 2013. Durga Vahini & Matri Shakti, the women wings of Vishwa Hindu Parishad came openly today against all those who have harassed women or those who are protecting the culprits. Delhi Girls are neither safe in their home state nor out side it. Smt. Simmi Ahuja & smt. Sanjana Chaudhary, the state conveners of Matri Shakti & Durga Vahini respectively issued a joint statement demanding immediate arrest of the culprits, strict enforcement of law, complete ban on Liquor and mandatory moral education in the entire country to save the mothers/would be mothers of men.

Briefing media after a meeting of Vishwa Hindu Parishad Delhi in its head quarters in Jhandewalan in central Delhi, its media chief shri Vinod Bansal said that our women wings have raised serious concern over Tejpal incident in Goa against a Delhi Girl. They have decided to complaint the National commission for Women and protest march in Delhi on Tuesday (26/11/2013). The VHP also demanded for complete ban on liquor and mandatory moral education apart from immediate arrest of Tejpal & his associates. It is very surprising that even after twelve days of incident, instead of lodging them into jail, the high profile culprits are roaming freely and their associates are misguiding and threatening the victim’s family, he added.

नई दिल्ली, 24 नवम्बर, 2013।  महिला उत्पीडन के मामलों में ढिलाई बरते जाने के विरुद्ध विहिप की महिला शाखा दुर्गा वाहिनी व मातृ शक्ति ने कमर कस ली है। दिल्ली की महिलाएं न अपने गृह राज्य राष्ट्रीय राजधानी क्षेत्र दिल्ली में सुरक्षित हैं और न हीं दिल्ली के बाहर। दुर्गा वाहिनी दिल्ली की प्रान्त संयोजिका श्रीमती संजना चौधरी और मातृ शक्ति की प्रान्त संयोजिका श्रीमती सिम्मी आहूजा ने आज एक बयान जारी कर कहा है कि दिल्ली की मुख्य मंत्री एक महिला होते हुए भी दुर्भाग्य से दिल्ली की बहिनें सर्वाधिक पीडित हैं। अभी हाल ही में गोआ में हुए तेजपाल प्रकरण व उत्पीडन की घटना ने तो और भी गंभीर सवाल खडे कर दिये हैं कि नाम चीन अपराधियों को गिरफ़्तार करने की जगह उनके साथ ढीलम-ढाल रवैया अपनाया जा रहा है। उन्होंने कहा कि हम शीघ्र ही राष्ट्रीय महिला आयोग से मिलेंगे और सरकारी उदासीनता के विरुद्ध मंगलवार को प्रदर्शन करेंगे।

आज हुई एक बैठक की विस्तृत जानकारी देते हुए विहिप दिल्ली के मीडिया प्रमुख श्री विनोद बंसल ने बताया कि राजधानी की महिलाओं के विरुद्ध चहुं-ओर बढती बलात्कार, छेडछाड व उत्पीडन की घटनाओं ने दिल्ली को शर्म सार कर दिया है। बैठक में इन घटनाओं को रोकने हेतु कारगर कदम उठाने तथा अपराधियों के विरुद्ध ढीलम-ढाल रवैए को छोड सख्ती से पेश आने की मांग करते हुए गोआ के नाम चीन अपराधियों को अविलम्ब गिरफ़्तार कर कडी से कडी सजा दिए जाने की मांग की है। बैठक में शराब पर पूर्ण प्रतिबन्ध व नैतिक शिक्षा को अनिवार्य करने की मांग भी की गई। दुर्गा वाहिनी व मातृ शक्ति ने तय किया है कि उनका एक दल न सिर्फ़ शीघ्र ही राष्ट्रीय महिला आयोग से शिकायत करेगा बल्कि मंगलवार (26/11/2013) को दिल्ली में रोष प्रदर्शन भी किया जाएगा।
